Please read this LUTEFISH STREAM™ Product Return and Limited Warranty Policy carefully.


This LUTEFISH STREAM™ Product Return and Limited Warranty Policy (the “Policy”) is entered into by and between purchaser (“you”) and Wenger Corporation, d/b/a Lutefish (“us,” “we,” or “our”) and governs purchases of the LUTEFISH STREAM™ (the “Product”) through www.lutefish.com (the “Lutefish website”).


By placing an order for the Product, you agree to be bound by this Policy, as updated from time to time. If you do not agree to any of the provisions set out in this Policy, you should not place an order for the Product. We may, in our sole discretion, modify or revise this Policy at any time. When we make any material change(s) to this Policy, we will provide you with notice, including: (a) by way of displaying a notice within the Lutefish website; or (b) by sending you an email to the email address that you provided to us, and the revised Policy will become effective one week after such notification. It is your responsibility to check the website on which this Policy is displayed from time to time for any updates.


You represent and warrant that you have read and understood this Policy and will abide by it, and that you are 18 years of age or more. IF YOU ARE NOT 18 YEARS OF AGE OR OLDER, YOU MAY NOT PURCHASE THE PRODUCT.


This Policy is an integral part of the Terms of Use that apply generally to the use of the Lutefish website (located at: https://lutefish.com/policies/terms-of-service). You should also carefully review our Privacy Policy (located at: https://lutefish.com/policies/privacy-policy) before placing an order for the Product through the Lutefish website.


1. Return Policy.

1.1 60-Day Money-Back Guarantee. If you are not completely satisfied with the Product for any reason, you have 60 days from the date of purchase to return the new or gently used Product for a full refund (less the original shipping and handling costs), subject to the terms and conditions set forth in this Policy.

1.2 Condition of Returned Product. The Product must be in good condition, not damaged beyond normal wear and tear, and include all original packaging and accessories.


1.3 How to Return the Product.


1.3.1 Contact our Customer Service Team at support@lutefish.com to initiate a return and receive a Return Material Authorization (“RMA”) number. Returns without an RMA may not be accepted.


1.3.2 Pack the Product, including all original accessories and documentation, securely in its original packaging.


1.3.3 Clearly mark the RMA number on the outside of the package.


1.3.4 Mail the package to the address provided by our Customer Service Team. All return shipping costs are your responsibility, and you bear the risk of loss during shipment.


1.4 Refund Processing. Refunds will be processed within 12 business days after we receive the returned Product. Refunds will be issued to the original method of payment. You will be notified via email once your refund has been processed. We do not charge restocking fees for returns.


1.5 Multi-Pack Returns. Returns of individual Products from multi-packs are permitted. However, please note that returning a single Product from a multi-pack will void the multi-pack discount. The refund amount will be adjusted accordingly to reflect the price of the individual Product rather than the discounted rate.


2. LIMITED WARRANTY.


THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT PURCHASED FROM THE LUTEFISH WEBSITE WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.


WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS LIMITED WARRANTY.


SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.


OUR RESPONSIBILITY FOR DEFECTIVE PRODUCTS IS LIMITED TO REPAIR OR REPLACEMENT, AS SET FORTH IN THIS LIMITED WARRANTY STATEMENT. NEITHER ANY PERFORMANCE OR OTHER CONDUCT, NOR ANY ORAL OR WRITTEN INFORMATION, STATEMENT OR ADVICE PROVIDED BY US OR ANY OF OUR SUPPLIERS, AGENTS OR EMPLOYEES WILL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OR DURATION OF THIS LIMITED WARRANTY.


2.1 Who May Use This Warranty? This limited warranty extends only to the original purchaser of the Product from the Lutefish website and does not extend to any subsequent or other owner or transferee of the Product.


2.2 What Does This Warranty Cover? This limited warranty covers, during the Warranty Period (as defined below), defects in materials and workmanship in the Product purchased from the Lutefish website.


2.3 What Does This Warranty Not Cover? This limited warranty does not cover any damages due to:


2.3.1 normal wear and tear, including, but not limited to, cosmetic damages such as scratches, nicks, stains and dents;


2.3.2 improper use of the Product or failure to follow Product instructions or perform preventative care and maintenance;


2.3.3 unauthorized repairs of, or modifications to, the Product;


2.3.4 use of the Product in connection with another product; or


2.3.5 external causes, such as accidents, abuse, or other actions or events beyond our reasonable control.


2.4 What Is the Period of Coverage? This limited warranty starts on the date of original retail purchase and lasts for one year (the “Warranty Period”). The Warranty Period is not extended if we repair or replace a warranted Product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.


2.5 What Are Your Remedies Under This Warranty? With respect to any defective Product during the Warranty Period, we will, in our sole discretion, either repair or replace the Product or any defective part free of charge. We will also pay for shipping and handling fees to return the repaired or replacement Product to you.


2.6 How Do You Obtain Warranty Service? To obtain warranty service, you must first contact us at support@lutefish.com during the Warranty Period to determine the problem and the most appropriate solution for you. Please be prepared to provide:


2.6.1 The serial number of the Product;


2.6.2 A description of the problem; and


2.6.3 A copy of the original receipt or proof of purchase. Proof of purchase is required to verify eligibility.


2.7 Limitation of Liability. THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT THAT YOU HAVE PURCHASED THROUGH THE LUTEFISH WEBSITE, NOR WILL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY LOSS OF PRODUCTION, WORK, DATA, USE, BUSINESS, GOODWILL, REPUTATION, REVENUE OR PROFIT, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT GOODS OR SERVICES, OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.


SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.


3. Applicable Law and Jurisdiction. This Policy shall be governed by and construed in accordance with Minnesota law, and all disputes shall be venued exclusively in a state or federal court situated in the State of Minnesota.


4. Waiver of Class Action. You and Lutefish agree that the resolution of any disputes between the parties shall be conducted in the parties’ individual capacities only and not as a class action or other representative action, and each expressly waives its right to file a class action or seek relief on a class basis. YOU AND LUTEFISH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.


5. WAIVER OF JURY TRIAL. YOU AND LUTEFISH EACH HEREBY IRREVOCABLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING OR COUNTERCLAIM (WHETHER BASED ON CONTRACT, TORT OR OTHERWISE) ARISING OUT OF OR RELATING TO THIS POLICY.


6. Entire Agreement. This Policy, the Lutefish website Terms of Use, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in this Policy.
